In this video, Restaurant Industry practice leader and Director Chaleise Fleming and Fractional CHRO Amy Hehman talk through how the One Big Beautiful Bill Act (OBBBA) is reshaping tax and payroll practices in the restaurant industry, with a focus on new deductions for tips and overtime. The legislation introduces above-the-line deductions that allow eligible employees to reduce taxable income on qualified tips and a portion of overtime pay (even if they don’t itemize), while still maintaining standard payroll tax treatment.

They unpack key changes to overtime calculations, including the requirement to factor in non-discretionary pay, like mandatory tip pooling, service charges, and bonuses. These updates increase payroll processing complexity and make accurate, real-time reporting much more critical.

For restaurant operators, the biggest challenges include updating payroll systems, ensuring compliance with new regulations, and clearly communicating changes to employees.
